3月25日，美國專利商標(biāo)局（USPTO）局長John Squires在美國眾議院司法委員會(huì)知識(shí)產(chǎn)權(quán)與AI小組委員會(huì)作證。表面看這是一次例行監(jiān)督聽證，但把他的整段致辭放到特朗普政府的AI政策、USPTO近期的PTAB調(diào)整、反欺詐治理和積壓清理背景下看，更像是一份新的施政宣言：USPTO不再只想做“審查機(jī)關(guān)”，而是要把自己定義成美國創(chuàng)新競(jìng)爭(zhēng)力的制度中樞。
一、他先改了USPTO的定位：從“發(fā)證機(jī)關(guān)”變成“創(chuàng)新中央銀行”

這篇致辭最值得注意的，不是某個(gè)具體數(shù)字，而是Squires給USPTO重新起的名字。他把USPTO稱為美國的“創(chuàng)新局”，把專利和商標(biāo)分別叫作“發(fā)明局”和“品牌局”，甚至直接把USPTO比作商務(wù)部的“創(chuàng)新中央銀行”。這不是普通修辭，而是在改寫機(jī)構(gòu)定位，知識(shí)產(chǎn)權(quán)不再只是法律確認(rèn)程序，而是就業(yè)、投資、產(chǎn)業(yè)競(jìng)爭(zhēng)和國家實(shí)力的供給機(jī)制。

這意味著，未來美國知識(shí)產(chǎn)權(quán)政策的核心目標(biāo)，可能不再只是“審得快一點(diǎn)、判得準(zhǔn)一點(diǎn)”，而是更直接地服務(wù)于美國技術(shù)優(yōu)勢(shì)、制造業(yè)回流、國家競(jìng)爭(zhēng)力和AI時(shí)代的制度搶位。國會(huì)聽證會(huì)頁面也明確寫明，這場(chǎng) hearing 審查的是 USPTO 的 mission、operations、policies。換句話說，Squires 不是來匯報(bào)日常工作的，他是在借國會(huì)場(chǎng)合，正式宣布 USPTO 的角色升級(jí)。

二、他真正想推的，是“AI接管流程”，而不只是“AI輔助辦公”

Squires 在發(fā)言里最用力展示的，是 AI。在商標(biāo)端，他說 agentic AI 分類工具把過去需要數(shù)月的人工檢索壓縮到幾秒級(jí)結(jié)果；在專利端，他說 AI 檢索助手能在第一次審查意見前給出 top 10 現(xiàn)有技術(shù)清單；跨專利和商標(biāo)體系，AI 反欺詐系統(tǒng)又幫助清理了 7 萬多件“無基礎(chǔ)申請(qǐng)”。這些表述都指向同一個(gè)方向：AI在USPTO內(nèi)部，已經(jīng)不再是試驗(yàn)項(xiàng)目，而是在進(jìn)入生產(chǎn)系統(tǒng)。他也表示，案件積壓在減少 5 萬件的基礎(chǔ)上，今年還要再減 10 萬件。

更重要的是，AI 在這里承擔(dān)的不是單一功能，而是三項(xiàng)制度任務(wù)：提效、控質(zhì)、清垃圾。提效，是壓縮分類和檢索時(shí)間；控質(zhì)，是讓審查員在首次審查前更快看到更完整的現(xiàn)有技術(shù)；清垃圾，則是通過反欺詐模型把異常申請(qǐng)、批量灌水和可疑注冊(cè)從系統(tǒng)里剔出去。對(duì)外界來說，這當(dāng)然是在講“技術(shù)升級(jí)”；但對(duì)國會(huì)來說，這其實(shí)是在證明：USPTO 值得繼續(xù)擁有收費(fèi)自主權(quán)，因?yàn)樗诎咽召M(fèi)收入轉(zhuǎn)化成可見的治理能力。

三、最重的一句話，其實(shí)是“America First IP”

如果說前兩點(diǎn)是在講機(jī)構(gòu)升級(jí)和技術(shù)升級(jí)，那么第三點(diǎn)就是在講政策方向升級(jí)。Squires 在致辭里明確提出，要建立一套“America First IP”議程。這句話不能只按政治口號(hào)理解。因?yàn)榫驮谶@場(chǎng)聽證會(huì)前后，USPTO圍繞PTAB、IPR立案裁量、國內(nèi)制造和國家安全因素，已經(jīng)釋放出越來越明顯的政策信號(hào)，美國知識(shí)產(chǎn)權(quán)制度正在被更強(qiáng)地嵌入產(chǎn)業(yè)政策和國家安全框架。

這意味著什么？意味著美國知識(shí)產(chǎn)權(quán)制度接下來的變化，可能越來越不是“純法律問題”，而是“法律+產(chǎn)業(yè)+地緣競(jìng)爭(zhēng)”的混合問題。誰能立案、誰更容易得到制度善意、哪些創(chuàng)新更值得被優(yōu)先保護(hù)、哪些程序會(huì)被解釋得更傾向本土制造和美國利益——這些都可能被重新排序。Squires 在聽證會(huì)上反復(fù)提“美國憲法傳統(tǒng)”、“美國全球領(lǐng)先”、“我們正在回到主動(dòng)位置”，核心不是抒情，而是在給這套新排序提供合法性敘事。

知產(chǎn)力判斷

這篇致辭，不是一次普通的國會(huì)匯報(bào)，而是一次明確的路線宣告。

第一，USPTO正在把自己從審查機(jī)構(gòu)，托舉為國家創(chuàng)新治理機(jī)構(gòu)。
第二，AI正在被寫進(jìn)美國知識(shí)產(chǎn)權(quán)行政能力，而不只是寫進(jìn)宣傳口號(hào)。
第三，美國知識(shí)產(chǎn)權(quán)制度接下來會(huì)更強(qiáng)地服務(wù)“美國優(yōu)先”的產(chǎn)業(yè)競(jìng)爭(zhēng)邏輯。

換句話說，未來美國知識(shí)產(chǎn)權(quán)制度最值得警惕的變化，未必只是專利法條怎么改、PTAB規(guī)則怎么調(diào)，而是整個(gè)制度的重心，正在從“中立審查”緩慢轉(zhuǎn)向“有方向的競(jìng)爭(zhēng)治理”。

這是Squires這篇致辭真正要傳遞的信號(hào)。

I am honored today to provide the Subcommittee an overview of the USPTO’s recent activities and accomplishments.

America’s Innovation Agency has two foundries:

And at scale, American ingenuity means national prowess and global reach.

Indeed, we lead today because our Founders did the extraordinary 2 centuries ago – enshrining IP protection into our Constitution. And with it – the American experiment itself, the American experience itself.

Last month, I told the head of the UK IPO how our Constitutional charge allows us to lean into AI, quantum, medical diagnostics – wherever the onrush of technology is going.

Think about that – the very empire we won our independence from: two democracies, two outcomes, but only one clearly atop the IP world today. That’s why it’s incumbent upon the USPTO to have an “America First IP” agenda built atop the unique legacy our Founders bestowed upon us. And we’re doing exactly that, with the urgency of now.

As I’m before you today, our first priority was slashing the unacceptable backlog by 50,000.

I’m confident, because we just announced our first agentic-AI Trademark Classification tool. Five months of manual searching, is now a FIVE-SECOND outcome.

In Patents, our AI search-assistant delivers a top ten list of prior art – before the first office action – providing quicker pathways to allowance.

同時(shí)，在專利和商標(biāo)兩大體系中，AI 反欺詐檢測(cè)又在不到一年的時(shí)間里，幫助我們清除了7萬多件缺乏基礎(chǔ)的申請(qǐng)。

And, across both, AI fraud detections helped us purge 70,000+ baseless filings – in just under a year.

You see, AI tools will become our Examiner’s super-powers, supplying them with a cadre of agents to deploy as they see fit.

On policy, Congress affords us discretion, and our north star to its exercise is always both the letter and the spirit of the AIA, balancing – as instructed – economic impact, resource efficiency, and the integrity our IP system.
