被起訴7人中包括中集集團總裁麥伯良、勝獅集團董事長(同時也是太平船務集團執行主席)張松聲赫然在列,其中,勝獅貨柜企業有限公司市場總監馬南興(Vick Nam Hing Ma)于2026年4月14日在法國被捕,目前正在等待引渡至美國!

美司法部通告稱:“七名中國企業高管和四家全球最大的集裝箱制造企業被控串謀限制全球幾乎所有標準非冷藏集裝箱的產量并操縱其價格,時間長達四年多,最早可追溯至 2019 年 11 月,至少持續到 2024 年 1 月,此舉違反了美國反壟斷法”。
據悉,這項長達數年的串謀活動使標準集裝箱的價格在 2019 年至 2021 年間幾乎翻了一番,在新冠疫情和全球供應鏈危機期間,集裝箱制造商的利潤增長了近百倍。
通告顯示:被告人馬南慶(Vick Nam Hing Ma),現年 54 歲,中國籍,曾任勝佳集裝箱控股有限公司(Singamas Container Holdings Ltd.)市場總監。今年 4 月14日在法國被捕后,美國加州北區地方法院5月19日公布了一份補充起訴書,指控馬南慶及其 10 名同謀合謀限制全球幾乎所有標準非冷藏集裝箱(也稱干柜)的產量并操縱其價格。

2019年11月14日左右,中集集團的萬永波和黃田化、上海寰宇物流裝備的李前敏、新華昌集團的張鈺強以及“共謀公司 A” 的一名同謀高管在深圳中集集團總部會面。該協議的目標是提高標準干貨集裝箱的價格。
為此,他們同意通過各種手段限制中集集團、上海寰宇物流裝備、新華昌集團以及共謀公司 A 的標準干貨集裝箱產量,包括以下幾大措施:
- Limiting the number of shifts and hours that each production line for standard dry containers could run per day;
限制每條標準干貨容器生產線每天可運行的班次和工時數; - Installing 87 video surveillance cameras on all 49 dry container production lines to ensure that the companies did not exceed the agreed-upon limitations;

不新建任何集裝箱制造廠; - Establishing a fund that included a mechanism to penalize financially any cheating on the output-restriction agreement.

補充起訴書指控被告違反《謝爾曼反壟斷法》第 1 條(15 USC § 1),犯有限制貿易的共謀罪。違反《謝爾曼法》對個人最高可判處 10 年監禁和 100 萬美元罰款,對公司最高可處以 1 億美元罰款。
如果犯罪所得或受害人損失超過法定最高罰款額,罰款可增至犯罪所得或受害人損失的兩倍。聯邦地區法院法官將在考慮《美國量刑指南》和其他法定因素后確定最終刑期。
