當地時間5月19日，美國司法部公共事務辦公室發布公告稱，全球四家最大的集裝箱制造公司及其七名高層管理人員“因涉嫌參與一項影響數十億美元商業操控陰謀”已被起訴！

被起訴7人中包括中集集團總裁麥伯良、勝獅集團董事長（同時也是太平船務集團執行主席）張松聲赫然在列，其中，勝獅貨柜企業有限公司市場總監馬南興（Vick Nam Hing Ma）于2026年4月14日在法國被捕，目前正在等待引渡至美國！

美司法部稱：“其余六名高管被告仍然在逃”！（Six executive co-defendants remain at large）

美司法部通告稱：“七名中國企業高管和四家全球最大的集裝箱制造企業被控串謀限制全球幾乎所有標準非冷藏集裝箱的產量并操縱其價格，時間長達四年多，最早可追溯至 2019 年 11 月，至少持續到 2024 年 1 月，此舉違反了美國反壟斷法”。

據悉，這項長達數年的串謀活動使標準集裝箱的價格在 2019 年至 2021 年間幾乎翻了一番，在新冠疫情和全球供應鏈危機期間，集裝箱制造商的利潤增長了近百倍。

通告顯示：被告人馬南慶（Vick Nam Hing Ma），現年 54 歲，中國籍，曾任勝佳集裝箱控股有限公司（Singamas Container Holdings Ltd.）市場總監。今年 4 月14日在法國被捕后，美國加州北區地方法院5月19日公布了一份補充起訴書，指控馬南慶及其 10 名同謀合謀限制全球幾乎所有標準非冷藏集裝箱（也稱干柜）的產量并操縱其價格。

這些集裝箱是多式聯運集裝箱，每年將價值數十億美元的貨物運往美國家庭。補充起訴書共指控 11 名被告，其中包括馬南慶的 10 名同謀。

以下為遭美司法部起訴的全球最大的4家集裝箱制造企業及7名高管：

• Singamas Container Holdings Ltd. (Singamas) also known as “勝獅貨柜企業有限公司” in Chinese, was a publicly traded company, organized and existing under the laws of Hong Kong in the People’s Republic of China. Singamas was engaged in the business of manufacturing dry shipping containers and selling them to customers in the United States and elsewhere.

• China International Marine Containers (Group) Co., Ltd. (CIMC), also known as “中國國際海運集裝箱（集團）股份有限公司” in Chinese, was a publicly traded company, organized and existing under the laws of the People’s Republic of China. CIMC was engaged in the business of manufacturing dry shipping containers and selling them to customers in the United States and elsewhere.
  中國國際海運集裝箱（集團）股份有限公司（簡稱“中集”）是一家根據中國法律組織成立并存在的上市公司。中集主要從事干貨集裝箱的生產和銷售，客戶遍及美國及其他地區。
• Shanghai Universal Logistics Equipment Co., Ltd., also known as “上海寰宇物流裝備有限公司” in Chinese, was a company organized and existing under the laws of the People’s Republic of China. Shanghai Universal Logistics Equipment Co., Ltd. (hereinafter “Dong Fang”) owned, managed, and did business as a brand of shipping containers called Dong Fang International Containers, also known as “DF”, “DFIC”, or Dong Fang. Dong Fang was engaged in the business of manufacturing dry shipping containers and selling them to customers in the United States and elsewhere.

• CXIC Group Containers Co. Ltd. (CXIC) also known as “新華昌集團有限公司” in Chinese, was a company organized and existing under the laws of the People’s Republic of China. CXIC was engaged in the business of manufacturing dry shipping containers and selling them to customers in the United States and elsewhere.
  新華昌集團有限公司（CXIC），又稱“新華昌集團有限公司”，是一家根據中國法律組織成立并存續的公司。新華昌集團有限公司主要從事干貨運輸集裝箱的生產和銷售，客戶遍及美國及其他地區。
• Siong Seng Teo, 71, also known as “張松聲” and “張松聲” in Chinese, and “S. Teo,” was employed by Singamas as Chief Executive Officer and Chairman. Teo is believed to be a resident of the Republic of Singapore.
  現年 71 歲的張松聲（Siong Seng Teo），中文名為“張松聲”或“張松聲”，也常被寫成“S. Teo”，曾任勝獅集團（Singamas）首席執行官兼董事長。據信張松聲是新加坡共和國居民。
• Boliang Mai, 67, also known as “麥伯良” in Chinese, was employed by CIMC in various senior roles. From August 2015 through July 2020, Mai served as President and Chief Executive Officer of CIMC. From August 2020 through the rest of the period covered by the Superseding Indictment, he served as Chairman and CEO of CIMC. Mai is believed to be a resident of the People’s Republic of China.

• Tianhua Huang, 62, also known as “黃田化” in Chinese and “T.H. Huang,” was employed by CIMC as Vice President. Huang is believed to be a resident of the People’s Republic of China.

• Yongbo Wan, 47, also known as “萬永波” in Chinese, was employed by CIMC as General Manager of CIMC’s Operation Management Center. Wan is believed to be a resident of the People’s Republic of China.
  萬永波，47歲，中文名“萬永波”，曾任中集集團運營管理中心總經理。據信萬永波是中國籍。
• Qianmin Li, 62, also known as “李前敏” in Chinese, was employed by Dong Fang as General Manager. Li is believed to be a resident of the People’s Republic of China.
  李前敏，62歲，曾任上海寰宇物流裝備有限公司（簡稱東方公司）總經理。據信李前敏是中國籍。
• Yuqiang Zhang, 49, also known as “張鈺強” in Chinese and “James Zhang,” was employed by CXIC as CEO. Zhang is believed to be a resident of the People’s Republic of China.
  張鈺強，49 歲，中文名“張鈺強”或“James Zhang”，曾任 CXIC 首席執行官。據信張鈺強是中國籍。

“這些被告被指控企圖利用全球疫情牟取暴利。他們非法串謀操縱價格并限制集裝箱供應，導致美國消費者不得不支付更高的價格，并等待更長時間才能收到關鍵物資，”加州北區聯邦檢察官克雷格·H·米薩基安表示。

根據補充起訴書的指控，早在 2019年3月，幾名共謀者就開始討論限制標準干貨集裝箱產量并操縱其價格的計劃。

2019年11月14日左右，中集集團的萬永波和黃田化、上海寰宇物流裝備的李前敏、新華昌集團的張鈺強以及“共謀公司 A” 的一名同謀高管在深圳中集集團總部會面。該協議的目標是提高標準干貨集裝箱的價格。

為此，他們同意通過各種手段限制中集集團、上海寰宇物流裝備、新華昌集團以及共謀公司 A 的標準干貨集裝箱產量，包括以下幾大措施：

• Limiting the number of shifts and hours that each production line for standard dry containers could run per day;
  限制每條標準干貨容器生產線每天可運行的班次和工時數；
• Installing 87 video surveillance cameras on all 49 dry container production lines to ensure that the companies did not exceed the agreed-upon limitations;
  在所有 49 條干貨集裝箱生產線上安裝 87 個視頻監控攝像頭，以確保各公司沒有超出約定的限制；
• Not building any new container manufacturing factories; and
  不新建任何集裝箱制造廠；
• Establishing a fund that included a mechanism to penalize financially any cheating on the output-restriction agreement.
  設立一項基金，其中包含一項機制，對任何違反產量限制協議的行為進行經濟處罰。

起訴書中進一步指控，中集集團集裝箱制造業務部門的利潤從2019年的約1980萬美元增長到2020年的約2.88億美元，再到2021年的約17.5億美元，增長了近百倍。勝獅集團的凈利潤也從2019年的約1.1億美元虧損，轉為2020年的約460萬美元盈利，并在2021年達到約1.868億美元。

補充起訴書指控被告違反《謝爾曼反壟斷法》第 1 條（15 USC § 1），犯有限制貿易的共謀罪。違反《謝爾曼法》對個人最高可判處 10 年監禁和 100 萬美元罰款，對公司最高可處以 1 億美元罰款。

如果犯罪所得或受害人損失超過法定最高罰款額，罰款可增至犯罪所得或受害人損失的兩倍。聯邦地區法院法官將在考慮《美國量刑指南》和其他法定因素后確定最終刑期。
